What is the EU AI Act?

The EU AI Act, formally known as Regulation (EU) 2024/1689 of the European Parliament and of the Council, is the world's first comprehensive legislation on artificial intelligence. It entered into force on August 1, 2024, and introduces harmonized rules for the development, market entry, and use of AI systems across the EU.

In Sweden, it is often called AI-lagen (the AI law) or AI-fΓΆrordningen. Unlike GDPR, which focuses on personal data, the AI Act regulates the AI systems themselves β€” regardless of whether they process personal data.

The regulation adopts a risk-based approach. The higher the risk an AI system poses to health, safety, and fundamental rights, the stricter the requirements for providers and deployers.

The AI Act applies not only to companies based in the EU. It also applies to providers outside the EU whose AI systems are used in the European market β€” the same way GDPR has extraterritorial reach.

Key concept: The AI Act defines β€œAI system” broadly as a machine-based system designed to operate with varying levels of autonomy, that may adapt after deployment, and that generates outputs (predictions, recommendations, decisions, or content) that can influence physical or virtual environments. The definition covers everything from advanced language models to simpler machine learning systems.

For Swedish businesses, this means anyone developing, distributing, or using AI systems in their operations needs to understand which requirements apply. It doesn't matter whether the company has 5 or 5,000 employees β€” it's the AI system's risk level that determines the regulatory burden.

The regulation complements existing EU legislation such as GDPR, the Product Safety Directive, and sector-specific rules for medical devices and vehicles. It also introduces new oversight structures with the AI Office at EU level and national supervisory authorities in each member state.

Timeline and deadlines

The AI Act enters into force gradually. Here are the key dates for Swedish businesses:

  • August 1, 2024: The regulation enters into force. No requirements are yet enforceable, but businesses should begin preparations.
  • February 2, 2025: Prohibitions on unacceptable-risk AI systems take effect. Social scoring, manipulative AI, and certain biometric surveillance become illegal.
  • August 2, 2025: Rules for general-purpose AI models (GPAI) take effect. Providers of foundation models like GPT and Claude must meet transparency and documentation requirements.
  • August 2, 2026: The main body of the regulation becomes applicable. All requirements for high-risk AI systems take effect, including technical documentation (Annex IV), risk management systems, and conformity assessment.
  • August 2, 2027: Additional requirements for high-risk systems also regulated by other EU legislation (e.g., medical devices, vehicles, aviation) take effect.
  • August 2, 2030: Existing high-risk AI systems used by public bodies must be fully compliant.

Critical deadline for Swedish businesses: By August 2, 2026, all providers and deployers of high-risk AI systems must comply with the AI Act requirements. That is less than 5 months away. Prepare now.

The phased implementation is designed to give businesses time to adapt, but in practice, high-risk compliance requires significant effort: risk assessment, documentation, quality management, and internal training. Waiting until the last minute is a high-risk strategy.

Risk levels in the EU AI Act

The core of the AI Act is a classification into four risk levels. Each level carries different obligations for providers and deployers.

1. Unacceptable risk (prohibited)

These AI systems are entirely prohibited in the EU from February 2, 2025. Examples:

  • Social scoring by public authorities or private actors leading to unjustified treatment
  • AI exploiting vulnerabilities of specific groups (children, elderly, disabled)
  • Biometric categorization based on sensitive characteristics (race, political opinion, sexual orientation)
  • Unauthorized real-time biometrics in public spaces (with exceptions for law enforcement under strict conditions)
  • AI systems manipulating human behavior in ways that cause harm, e.g., covert techniques to override free will

2. High risk

High-risk AI systems face the strictest regulations. They are defined in Annex I (AI as safety components in products) and Annex III (standalone AI systems in sensitive areas). Examples of high-risk include:

  • AI for recruitment, selection, and employee assessment
  • Credit scoring and creditworthiness assessment for individuals
  • AI in medical devices and diagnostics
  • AI systems in education affecting access to educational institutions
  • AI for access to and use of public services and benefits
  • AI in law enforcement (e.g., risk assessment, profiling)
  • Biometric identification and authentication
  • AI systems for managing critical infrastructure (energy, water, traffic)

3. Limited risk

Limited-risk AI systems have transparency and information obligations. Users must be informed that they are interacting with AI. Examples:

  • Chatbots and conversational AI (must disclose they are AI)
  • AI generating synthetic content (images, audio, video) β€” must be labeled
  • Emotion recognition systems β€” must inform affected persons

4. Minimal risk

Most AI systems fall under minimal risk and have no specific legal requirements under the regulation. This includes spam filters, AI-powered recommendation systems for e-commerce, and most AI tools for internal productivity. However, providers are encouraged to voluntarily follow codes of conduct.

Requirements for high-risk AI systems

If your AI system is classified as high-risk, the regulation imposes extensive requirements. They are designed to ensure safety, transparency, and human control throughout the AI system's lifecycle. Here are the key obligations under Chapter III, Section 2 of the regulation:

Risk management system (Article 9)

You must establish an ongoing risk management system that identifies, analyzes, and mitigates risks throughout the AI system's lifecycle. A one-time assessment is not sufficient β€” the system must be regularly updated and documented.

Data and data governance (Article 10)

Training, validation, and test data must meet quality criteria. The data should be relevant, representative, and as free from bias as possible. You need to document data origin, preprocessing, and any limitations.

Technical documentation (Article 11 & Annex IV)

Providers must prepare detailed technical documentation according to Annex IV. The documentation must show how the system works, how it was developed, what data was used, how performance was measured, and what risks were identified. The documentation must be kept up to date throughout the system's lifetime.

Record-keeping (Article 12)

High-risk AI systems must automatically log events during operation. The logs must enable tracing of the system's behavior and facilitate post-incident analysis in case of incidents or complaints. The logging period is at least six months.

Transparency and information (Article 13)

The AI system must be sufficiently transparent for deployers to interpret and use its outputs correctly. Instructions for use must include information about the system's capabilities, limitations, risks, and intended purpose.

Human oversight (Article 14)

There must be mechanisms for human oversight and the ability to consider, understand, and, where necessary, override the AI system's decisions. A human must be able to interrupt or stop the system if it behaves incorrectly.

Accuracy, robustness, and cybersecurity (Article 15)

The AI system must achieve an appropriate level of accuracy, robustness, and cybersecurity. The system must be tested against expected performance and be resilient to errors, attacks, and manipulation.

Who is affected by the EU AI Act?

The AI Act defines four main roles with different obligations. Most Swedish businesses working with AI fall under at least one of these categories.

Providers

Providers are companies that develop AI systems or have AI systems developed and place them on the market or put them into service under their own name or trademark. They bear the heaviest responsibility: risk management, technical documentation, conformity assessment, CE marking, and post-market surveillance.

If your Swedish company builds an AI tool that is sold or used by others β€” whether it's a SaaS product, an API, or an embedded component β€” you are likely a provider.

Deployers

Deployers are organizations that put an AI system into service in their operations. Deployers of high-risk systems must follow instructions for use, monitor the system's operation, conduct a FRIA (Article 27), and report serious incidents.

If your company purchases or licenses an AI system for recruitment, credit scoring, or customer service, you are likely a deployer with your own compliance obligations.

Importers

Importers are EU-based companies that place AI systems on the EU market from third countries. They must verify that the non-EU provider has conducted conformity assessment, that CE marking is in place, and that documentation is complete.

Distributors

Distributors make AI systems available on the market without modifying them. They must verify that CE marking and documentation are in place and report if they discover non-compliance.

Important for Swedish SMEs: Many Swedish companies are both providers and deployers at the same time β€” for example, if you develop an internal AI tool for recruitment. In that case, obligations for both roles apply. SMEs receive some relief through Article 62a (regulatory sandboxes and support measures), but the fundamental requirements apply to all.

Penalties and fines

The AI Act introduces significant financial penalties for non-compliance. The fine levels are higher than GDPR for the most serious violations:

  • Up to €35 million or 7% of global annual turnover (whichever is higher) β€” for use of prohibited AI systems (Article 5).
  • Up to €15 million or 3% of global annual turnover β€” for violations of high-risk AI system requirements, including inadequate documentation, lack of risk management systems, and insufficient human oversight.
  • Up to €7.5 million or 1% of global annual turnover β€” for incorrect or misleading information provided to supervisory authorities.

For small and medium-sized enterprises and startups, fines are adjusted proportionally, but they can still be devastating. The exact enforcement is determined by national supervisory authorities β€” in Sweden's case, the designated authority has not yet been finalized.

Beyond financial penalties, the supervisory authority can require an AI system to be withdrawn from the market or prohibited until deficiencies are remedied. For businesses that depend on their AI system, this can be even more serious than a fine.

Perspective: GDPR's highest fines are 4% of global annual turnover. The AI Act's highest level is 7% β€” nearly double. Regulatory compliance is not optional.
